Courier terms
These terms apply when you deliver with the Delo Driver app. They are written to be read, so each section starts with what matters most. If anything is unclear, email rider@delo.ie.
1. Who we are
Delo and Delo Driver are run by Eclyde Corporation Limited, a company registered in Ireland with its office in Dublin (CRO 810069). In these terms "Delo", "we" and "us" mean Eclyde Corporation Limited, and "you" means the courier using the app.
Delo is a marketplace where people order from local shops. Delo Driver connects those orders with couriers who choose to deliver them. You accept these terms when you continue past the details step of verification in the app.
2. You are self-employed
You deliver as an independent contractor, not as an employee or worker of Delo or of any shop.
- You decide if, when, where and for how long you go online. There are no shifts and no minimum hours.
- You are free to deliver for other apps and businesses, including our competitors, at any time.
- You use your own vehicle, phone and equipment and pay their running costs.
- You are responsible for your own income tax, USC and PRSI. Delo reports payments to Revenue where the law requires it, which is why we ask for your PPS number.
- Nothing in these terms creates employment, partnership or agency between you and Delo.
If you deliver only for one shop as that shop's own driver, your arrangement with the shop is between you and the shop. These terms still cover your use of the app.
3. Joining
To deliver with Delo Driver you must:
- be 18 or over and entitled to work in Ireland;
- pass an identity check, run by our payment provider Stripe, which matches your photo ID to a live selfie;
- add a bank account in your own name for payouts;
- give true, current details and keep them up to date;
- keep your account to yourself. Nobody else may sign in or deliver as you.
In some areas you need an invite code to join. We may decline an application, for example where an identity check fails or an area has enough couriers.
4. Offers
When you are online, the app offers you deliveries near you. Every offer shows, before you accept: what you will earn for it (the delivery fee, any bonus and any tip already added), where the pickup and the drop-off are, and how far they are.
- You are free to accept or decline any offer, or let it time out.
- Declining never counts against you. It does not lower your future offers, your tier or your standing with Delo.
- Offers go to couriers based on distance, who is online and free, and the vehicle suited to the order. We explain in the app how offers work, and you can ask us about any offer.
Once you accept, please complete the delivery. If you cannot, tell us straight away through the app or by calling support so the order can reach the customer another way.
5. Pay and tips
- Delivery pay is what the offer showed when you accepted it. We do not reduce it afterwards.
- Waiting pay applies when an order is not ready when you arrive at the shop, counted from your arrival, at the rate shown in the app.
- Tips belong to you. Every cent a customer tips is passed on to you in full, including tips added after delivery. Delo takes nothing from tips.
- Bonuses and tiers, where offered, are explained in the app before they apply.
- The app shows your earnings for every delivery, every day and every week, and you can download statements for your tax return.
If you think a payment is wrong, tell us within 60 days and we will look at it and reply. We pay any shortfall we find with your next payout.
6. Payouts and instant cash-out
- Weekly payouts. Your earnings for each week are paid to your bank account every Tuesday, free of charge, through our payment provider Stripe. Banks can take one to two working days to show the money.
- Instant cash-out is optional. It lets you take the earnings already available to you straight away, instead of waiting for Tuesday. It carries a fee of 1% of the amount, with a minimum of €0.50, which is shown before you confirm. The fee is set to cover what the payment provider charges for an instant transfer. If you never use it, you never pay it.
- Instant cash-out depends on your bank supporting instant transfers and may be unavailable at times. When it is, your earnings are paid in the next weekly payout as usual.
- We may hold a payment while we look into suspected fraud or a serious complaint. We will tell you why and release it as soon as the question is settled.
7. Delivering
- Collect the order from the shop, check it matches the app, and give the handover code if asked.
- Keep orders closed and secure, and deliver them promptly and in good condition.
- Obey the rules of the road and the law at all times. Never use your phone in a way that is unsafe or illegal while moving.
- For orders containing alcohol, check the customer is 18 or over, using the ID check guide in the app. If you cannot confirm it, do not hand the alcohol over.
- Use customers' names, addresses and phone numbers only for the delivery you are doing, and never keep, copy or share them.
8. Photo proof of delivery
The app asks you to take a photo when you complete a delivery, showing the order where you left it or handed it over. The photo is kept with the order in your Delo account and used to settle questions about whether an order arrived, which can mean showing it to that order's customer or shop. Frame the order, not people, and avoid showing the inside of someone's home.
9. When nobody answers
If the customer does not answer at the door, call them from the app. If there is still no answer after the waiting time shown in the app, you can leave the order where the app allows, return it to the shop, or tell us you cannot return it (for example if the shop is closed or too far away). The app guides each step, and you are paid for a returned order as shown in the app.
10. Your location
- The app uses your location only while you are online, to offer you nearby deliveries and show your route. It continues with the phone locked during a shift, and stops the moment you go offline.
- While you carry an order, that order's customer can see your approximate position on their order page, from collection until it is delivered. The app shows you a notice naming who can see you the whole time. Nobody else outside Delo sees it.
- Delo uses location data to run deliveries, help you if something goes wrong, and resolve questions about a delivery. Our courier privacy notice explains what we keep and for how long.
11. Conduct
We ask every courier, customer and shop to treat each other with respect. You must not:
- harass, threaten, discriminate against or abuse anyone;
- deliver while under the influence of alcohol or drugs;
- contact a customer for anything other than their delivery, or after it is complete;
- open, tamper with or take anything from an order;
- let anyone else use your account, or use false details, GPS tricks or any other way to game offers or pay.
If you are hurt, threatened or treated badly on a delivery, report it in the app under Account, Report an incident, or call support. You never have to complete a delivery that puts you at risk.
12. Suspension and ending
You can stop delivering at any time, for any reason, without notice.
We may suspend or end your access if you seriously or repeatedly break these terms, if there is fraud or a real safety risk, or if the law requires it. Before we end your access we will tell you why and give you a chance to respond, unless the law or someone's safety prevents that. Decisions to suspend or end an account are always reviewed by a person at Delo, and you can ask for the decision to be looked at again. Money you have already earned is still paid.
13. Deleting your account
You can delete your account at any time in the app under Account, Delete account, or by emailing rider@delo.ie. Deletion removes your courier account, your details and your sign-in. Anything you have already earned is still paid. We keep payment and tax records for as long as the law requires, as the courier privacy notice explains.
14. Insurance and liability
- You are responsible for your vehicle being roadworthy, taxed and legal, and for holding the licence it needs.
- You are responsible for your own insurance. Where the law requires it, that includes motor insurance that covers using your vehicle for deliveries (hire and reward). Delo does not insure you, your vehicle or your equipment.
- You are responsible for loss or damage you cause by your own negligence or by breaking these terms.
- Delo is not responsible for losses that were not foreseeable, or for loss of business or profit. We do our best to keep the app working, but cannot promise it will always be available or free of errors.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under Irish law.
15. Changes to these terms
We will tell you in the app at least 14 days before a change to these terms that affects your pay or how you work, unless the law requires a change sooner. Changes to pay never affect an offer you have already accepted. If you do not agree with a change, you can stop using the app and delete your account.
16. Law and disputes
These terms are governed by the law of Ireland, and the courts of Ireland have jurisdiction over any dispute. Please talk to us first: most problems are sorted out quickly by email or phone.
